The Provider currently operates as a natural person (self-employed professional) under Art. 10 LSSI-CE. A limited company (SL) is planned and will assume the Provider’s position by automatic novation, without any need for re-acceptance; the registration details will be published once the Companies Registry entry is complete.

2. Purpose

This Legal Notice governs the general terms of access to and use of the vret.es / vret.app website and its subdomains (the “Site”), owned by the Provider identified in section 1.

Use of the Site confers User status and implies full acceptance of this Legal Notice, the Privacy Policy and the Cookie Policy. Contracting the VRET SaaS service is additionally governed by the Terms of Service and the DPA.

3. Conditions of use of the Site

The User undertakes to:

  • Use the Site in accordance with applicable law, public order and these conditions.
  • Not reproduce, distribute, modify or commercially exploit the Site content without the Provider’s authorisation.
  • Not perform actions that may impair, overload or prevent the normal operation of the Site or the SaaS platform.
  • Not introduce malicious code or programs that could cause damage, or attempt to access restricted areas without authorisation.

4. Intellectual and industrial property

All Site content (text, images, source code, logo, the VRET brand, graphic design, the Lumi mascot, visual motifs, audio, video) is owned by the Provider or used with due authorisation from its legitimate holders. Third-party assets under CC0 or equivalent licences are listed at /creditos.

Reproduction, distribution, public communication, transformation or any other exploitation of the Site content without prior written authorisation is expressly prohibited, except for private use and quotation under art. 32 of the Consolidated Text of the Spanish Intellectual Property Act.

5. Liability and availability

The Provider does not guarantee the continuous and permanent availability of the Site, which may be interrupted by technical causes, maintenance, updates or force majeure. Liability for the contracted SaaS service is governed by the Terms of Service.

The Provider is not responsible for misuse of the Site by the User, or for the content of external linked pages, which are provided for informational purposes only.

6. Commercial communications (Art. 21 LSSI-CE)

The Provider will only send commercial communications by email where one of the following circumstances under Art. 21 LSSI-CE applies:

  • There is prior, express and informed consent from the recipient (collected via double opt-in on Site forms).
  • There is a prior contractual relationship with the recipient and the communication concerns products or services similar to those contracted, offering in each communication a free and simple opt-out link.

The User may withdraw consent at any time from the link at the foot of each email or by writing to privacidad [arroba] vret.es.

7. Data protection

Processing of the User’s personal data is governed by the Privacy Policy, which incorporates the information required by Art. 13 GDPR.

8. Cookies

The use of cookies on the Site is governed by the Cookie Policy, under Art. 22.2 LSSI-CE.

9. Complaints and dispute resolution

VRET provides a service exclusively between professionals (B2B); it is not directed at consumers. The Provider handles any complaint through its usual channels (contacto [arroba] vret.es). The dispute resolution route and applicable forum are those set out in the Terms of Service and, where applicable, in the master services agreement signed with the Client.

10. Governing law and jurisdiction

This Legal Notice is governed by Spanish law and, in particular, by Law 34/2002, of 11 July, on Information Society Services and Electronic Commerce (LSSI-CE). As a service directed exclusively at professionals (B2B), consumer-protection legislation does not apply. Disputes are submitted to the jurisdiction set out in the Terms of Service.
